Sounds like a bug to me.  I'd check with Bethesda / Xbox for help

Worse comes to worse, return the game for a new copy and try it.  There could be a problem with the disc itself.

Yeah, just a bug I would say.
Contact Bethesda and get some support. Or contact the store you purchased the game from and grab a new copy. I'm sure they would replace it for you.

Check the disk and make sure that there are no scratches (even tiny ones) if there is just take it back to where you got it along with the reciept, they should replace it for you as it will still be within 30 days of purchase.
